The unique process of contract formation\, the lack of consistency in\nhow reinsurance contract is codified among different jurisdictions and no common understanding of customs\nand usages on which reinsurance law is largely based – it all comes down to the lack of legal certainty affecting\nthe overall quality of reinsurance coverage. \nIn pursuit of looking for a solution\, leading academics from the University of Zurich\, University of Frankfurt am\nMain and University of Vienna established in 2015 an international project called the Principles of Reinsurance\nContract Law (PRICL). The Project is run in cooperation with UNIDROIT\, scholars and (re)insurance practitioners from all over the world. \nPRICL_25.01.2023_flyer\nThe PRICL aspires to formulate a “restatement” of existing global reinsurance law and providing the reinsurance\nmarket with transnational uniform soft law rules which are ready to be used in practice. The first volume of the\nPRICL was published in 2019 and is publicly available at the PRICL Project’s website. Today\, the Project is in its\nfinal phase and the second and last volume is expected to be published by the end of 2024. \nThe event offers a unique opportunity to find out how the PRICL may solve the abovementioned problems of\nreinsurance market and how the Principles could be used in practice\, for instance in reinsurance disputes arising\nover COVID-19 claims. The presentation will be followed by a discussion and Q&A session. \nWe highly value discussing ideas in person\, strengthening social bonds\, and enlarging the community around\nthe PRICL Project. SUMMARY:12th Cape Town Convention Academic Project Conference 2023
DESCRIPTION:This year’s Conference will be held on Wednesday 27th and Thursday 28th of September 2023. It will be held in Cambridge as an in-person conference\, but also with the opportunity to join virtually for anyone who is not able to join in person. The conference will be held at Jesus College\, University of Cambridge \nThe Conference this year will focus on Enforcement and Dispute Resolution in relation to the Cape Town Convention. The programme will include contributions from leading academics and other experts\, as well as discussion involving Cape Town Convention experts from all fields. As always\, the Conference will be highly interactive\, with each session including ample opportunity for questions and debate. \nThe Conference will be preceded on 26th September by a moot involving students from Oxford and Cambridge Universities. The moot\, which will be judged by Mr. Justice Zacaroli and Professor Riz Mokal\, is one of the first to take place under the Cape Town Convention International Moot Programme\, the purpose of which is to familiarise students and judges with the CTC in the context of complex hypothetical fact patterns and to provide students with educational exercises involving these instruments in a simulated judicial setting. The moot will take place at 5pm in Jesus College\, University of Cambridge\, and all those attending the conference in person are invited to attend the moot. \nConference sessions will include discussions of the meaning of procedural law (with particular reference to the CTC)\, CTC Article 42 and forum non conveniens\, relief pending final determination and enforcement of treaty breaches in the CTC context\, as well as analyses of the CTC caselaw in the light of the interpretative requirements of Article 5 CTC and of the mechanics and dynamics in practice of enforcement in insolvency. There will also be sessions on leasing and the CTC\, and the relationship between project finance and asset finance. Two lunchtime sessions will reflect on the coming into force of the Luxembourg Rail Protocol\, and on lessons to be learnt for the moot programme from the moot on 26th September. \nThe Conference will take place in West Court\, Jesus College\, Cambridge\, CB5 8BQ. There will be a conference dinner at Jesus College on the evening of the 27th of September. Refreshments during the two days of the conference and the conference dinner are included in the conference fee of £330 for in person attendance.
