UNIDROIT launches consultation on draft Principles on the Legal Nature of Verified Carbon Credits

UNIDROIT has opened a public consultation in relation to the draft UNIDROIT Principles on the Legal Nature of Verified Carbon Credits (VCCs).

The draft Principles aim to provide legislative guidance on private law issues so as to enhance confidence in VCC transactions and support the development of a well-functioning carbon market. The instrument has been developed by a Working Group composed of international experts representing different legal systems, as well as of representatives from interested government agencies, intergovernmental organisations, industry associations, and non-governmental organisations.

The purpose of the consultation is to raise awareness about the instrument, encourage broad participation of stakeholders in the final stage of the drafting process, seek feedback on whether the instrument sufficiently addresses the core issues relating to the trade in VCCs, ensure that the instrument is well-suited to application in different contexts and provides a balanced legal framework from a commercial and a property law perspective.

The consultation will remain open until 21 September 2026. All information relating to the consultation, including the text of the draft instrument and details as to how to submit comments, is available on the dedicated consultation webpage: https://www.unidroit.org/work-in-progress/verified-carbon-credits/2026-wg-pc/
