FINANCIAL MARKETS AND TECHNOLOGY WORKSTREAM

UNIDROIT’s work on capital markets was included in the Work Programme of the Institute in 2001. The instruments adopted include:

Ongoing work on the Principles on the Legal Nature of Verified Carbon Credits represents a unique intersection between financial markets and sustainability, as well as the new projects in UNIDROIT’s 2026-2028 Work Programme on (i) Regulation of Digital Risks through Civil Liability Law, (ii) Insolvency of Insurers, and (iii) Legal and Regulatory Aspects of Investment-based Crowdfunding.

The first online meeting of the FMT WS was held on 22 July 2025. Prior to the meeting, the Secretariat circulated a draft Inception Report providing an overview of UNIDROIT’s instruments in the financial markets and technology area, outlining their development and adoption, objectives, key content, and impact, as well as presenting some preliminary analysis on their strengths and weaknesses for the Committee’s consideration. The FMT WS discussed the scope of the future White Paper, and members expressed interest in specific topics. It was agreed that, during the intersessional period, members would cooperate in small groups to begin drafting their respective texts and submit them to the Secretariat ahead of the second meeting.

The second online meeting, held on 13 October 2025, focused on the discussion of the draft proposals submitted by members. The FMT WS adopted the work plan for 2025–2026 and invited the Secretariat to prepare a draft structure of the future White Paper, on the basis of which members would update their texts.

The third online meeting was held on 7 November 2025 to review the updated draft proposals. Members provided further comments, and it was agreed that, based on the discussions held, members would finalise their revisions in early December 2025.

The fourth online meeting, held on 24 February 2026, further discussed the content and structure of the draft White Paper.

The fifth online meeting, held on 13 April 2026, discussed the draft White Paper in light of the comments and discussions of the Committee, in parallel with the preparations of the hybrid workshop.

The sixth online meeting, held on 29 June 2026, further discussed the revised draft White Paper, as well as the agenda and organisational arrangements for the hybrid workshop.

The Financial Markets and Technology Workstream Workshop will be held at UNIDROIT on 11 September.

A hybrid workshop will be held on 11 September 2026. The comments received from internal and external experts during the workshop will be considered by the Committee and incorporated as appropriate. The White Paper is expected to be finalised in October 2026. 

Participation in the FMT Workstream Workshop is limited to invited participants.The Workshop is organised within the framework of the UNIDROIT International Programme for Law and Development (IPLD) focused on the Balkans, Eastern Partnership, Central Asia, and the Caucasus (BEPCAC) and will benefit from the participation of judges and other legal professionals from across the BEPCAC region.
