PRIVATE LAW AND AGRICULTURE

Recognising the crucial role private law can play in agriculture development, the UNIDROIT General Assembly decided in 2010 to include a dedicated line of work to this area in the Institute’s Work Programme. Since then, UNIDROIT has established partnerships with other intergovernmental organisations such as the Food and Agriculture Organization of the United Nations (FAO), the International Fund for Agricultural Development (IFAD) and the United Nations Commission on International Trade Law (UNCITRAL) to leverage synergies and develop joint projects.

The Workstream on Agriculture Development, established for the UNIDROIT Centenary, encompasses the following key instruments: UNIDROIT/FAO/IFAD Legal Guide on Contract FarmingUNIDROIT/IFAD Legal Guide on Agricultural Land Investment Contracts, UNICITRAL-UNIDROIT Model Law on Warehouse Receipts and the ongoing work on Collaborative Legal Structures for Agricultural Enterprises. While issues related to access to finance in the agricultural sector (e.g., MAC Protocol) are addressed under a separate Workstream, their content may nonetheless be considered within the broader analysis undertaken by this committee, given the interrelated nature of these topics.
