PRIVATE LAW AND AGRICULTURE WORKSTREAM

In 2010, acknowledging the importance of this particular sector, the UNIDROIT General Assembly decided to include aspects of the private law of agricultural development in the Work Programme of the Institute. Since then, UNIDROIT has developed a line of work specifically devoted to the crucial role private law can play in agricultural development.

The Private Law and Agriculture Workstream (PLA WS) covers some key instruments and projects of the Institute, including the 2015  UNIDROIT/FAO/IFAD Legal Guide on Contract Farming; the 2019 Protocol to the Cape Town Convention on Matters Specific to Mining, Agriculture and Construction Equipment; the 2021 UNIDROIT/IFAD Legal Guide on Agricultural Land Investment Contracts; the 2024 UNCITRAL–UNIDROIT Model Law on Warehouse Receipts; as well as the ongoing UNIDROIT/FAO/IFAD Project on Collaborative Legal Structures for Agricultural Enterprises, and the future project to develop an Agricultural Finance Guide.

In addition to these instruments and projects, the Workstream is also conducting broader legal research on general issues concerning the relevance of private law in the agricultural sector with a view to identifying emerging challenges and explore future directions for UNIDROIT’s work in this vital field.

  • First Meeting (online, 14 July 2025)

The first meeting introduced the objectives, scope, and timeline of the Workstream.

The Committee discussed the Inception Report, which reviewed UNIDROIT’s existing instruments and ongoing initiatives. The methodology and strategic orientation of the future White Paper was also considered.

  • Second Meeting (online, 13 November 2025)

The second meeting focused on the organisation of the White Paper drafting process.

The Committee confirmed task allocations and discussed the draft outline and methodology of the White Paper.

  • Third Meeting (online, 5 February 2026)

The third meeting focused on the discussion of the first draft contributions prepared by Committee Members.

The Committee also discussed how the drafts would be integrated into the agreed draft outline.

  • Fourth Meeting (online, 30 March 2026)

The fourth meeting focused on the consolidated draft White Paper prepared by the Secretariat, which brought together all members’ contributions into a single document.

The Committee provided comments on the draft, identified sections that required further development, and assigned those parts among members for revision.
