UNIDROIT participates in the 4th CERIL conference

On 26-27 March 2026, UNIDROIT participated in the 4th CERIL International Conference: “After the Big Bang: Europe’s expanding restructuring and insolvency law regime”, held in Leuven, Belgium. The conference focused on EU insolvency law and brought together strong participation from academia, legal practice, the judiciary, and policy-makers.

UNIDROIT Legal Consultant Theodora Kostoula took part in Panel V “Into the digital age”, which explored the opportunities, challenges and risks arising from digitalisation reshaping the insolvency practice – from digital assets and registers to AI and digital proceedings. The panel was chaired by Professor Paula Moffatt (Nottingham Law School, UK) and also featured the participation of Theoni Alampasi (Ministry of Finance, Greece), Tina Rebecca Balzli (CMS, Switzerland), An-marie Buyse (Aginco, Belgium) and Ilya Kokorin (Dutch Authority for the Financial Markets, the Netherlands).

In her intervention, Ms Kostoula discussed some of the most pressing legal challenges, focusing on the treatment of digital assets within the insolvency estate, particularly in cases involving insolvent intermediaries. She explained how these issues are addressed under the UNIDROIT Principles on Digital Assets and Private Law, with particular emphasis on the custody principles and shortfall mechanisms, and explored their interaction with the EU Regulation on Markets in Crypto-Assets (MiCAR).
