UNIDROIT participates in the XX Colombian Congress of Insolvency Law

From 17 to 19 September 2026, UNIDROIT Legal Consultant Dr Theodora Kostoula participated in the XX Colombian Congress of Insolvency Law, held in Cartagena de Indias, Colombia, under the theme “20 Years of Colombian Insolvency Law: Between Law 1116 and International Harmonisation.”

The Congress brought together approximately 300 participants, including insolvency lawyers, practitioners, academics and representatives of public institutions to reflect on two decades of the Colombian insolvency framework, its implementation and the challenges that may shape its future development.

Dr Kostoula delivered a detailed presentation on “The Treatment of Digital Assets in Insolvency”. Building on the Congress’s broader discussion of the evolution and future of insolvency law, Dr Kostoula focused on the approach taken in the UNIDROIT Principles on Digital Assets and Private Law (DAPL Principles). Through case studies, her presentation examined the legal challenges posed by digital assets in insolvency through case studies, how the Principles respond to private-law uncertainties affecting digital assets and market participants, and their role in providing a coherent private-law foundation for the treatment of such assets when insolvency occurs.

The Congress provided an important opportunity to present UNIDROIT’s work on digital assets to the Colombian insolvency law community and to exchange views on how domestic insolvency frameworks can respond to emerging forms of digital assets and how internationally harmonised private-law principles can support this process.
