On 23 April 2025, the second session of the Supervisory Authority of the Luxembourg Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Railway Rolling Stock (“Supervisory Authority”) was held in Bern, Switzerland, and online, hosted by the Intergovernmental Organisation for International Carriage by Rail (OTIF), which is the Secretariat of the Supervisory Authority.
The session was attended by members of the Supervisory Authority (representatives of contracting States and representatives of other States appointed by OTIF and UNIDROIT) as well as institutional and individual observers.
After a welcome by Mr Aleksandr Kuzmenko, the Secretary General of OTIF, the session was opened by Prof. Teresa Rodriguez de las Heras Ballell, representing Spain as the Chair of the Supervisory Authority. Notably, the Supervisory Authority approved the Model Rules on the Permanent Identification of Railway Rolling Stock as amended on 13 November 2024 by the Revisions Committee, for the purposes of the Regulations for the International Registry of Interests in Rolling Stock, and considered revisions of the Supervisory Authority’s Statutes and Rules of Procedure. The Supervisory Authority also appointed additional members to the Commission of Experts for the Supervisory Authority. Moreover, the Supervisory Authority considered reports by the Depositary on the status of ratifications and activities since the first Supervisory Authority session by UNIDROIT Deputy Secretary-General Prof. Anna Veneziano; on the activities of the Secretariat by Ms Lunesterline Andriamahatahitry; on the functioning of the international registration system by Regulis SA, the international Registrar; and information on the activities organised by the Rail Working Group by its Chairman, Mr Howard Rosen.
Following the second session of the Supervisory Authority, the Rail Protocol’s Ratification Task Force (RTF) also held a meeting, both in-person in Bern and online. Attended by representatives of States as well as OTIF, the Registrar, and the Rail Working Group, the meeting was chaired by UNIDROIT. The Chair addressed the RTF’s composition and new members before delving into a discussion of the report on promotion and implementation activities since the most recent RTF meeting in July 2024. Participants received updates about implementation in Luxembourg as the State of the seat of the Registrar, implementation in other contracting States, the process towards ratification in other States, the activity of the International Registry, planned activities and events for 2025 and 2026, and other initiatives. There was opportunity for interventions by participating States and observers. It was agreed that another meeting of the RTF would need to be organised in the coming months and that future meetings should be held at shorter intervals.
