Asian Development Bank hosts roundtable in Manila on the UNIDROIT-ICC Project on the UPICC and International Investment Contracts

On 9 February 2026, the Co-Chair of the UNIDROIT-ICC Working Group on the UPICC and International Investment Contracts and President Emerita, Professor Maria Chiara Malaguti and UNIDROIT Senior Legal Officer Dr. Rocco Palma, as well as Senior Legal Officer Ms Myrte Thijssen (connecting on line) participated in a roundtable hosted by the Asian Development Bank in Manila, entitled “The UNIDROIT-ICC Draft Instrument on International Investment Contracts and the ADB investment and sustainability policy”.

The event was part of a collaboration between UNIDROIT and the ADB, which started in August 2025, continued through an online presentation of the Project to key ADB officers on 9 December 2025, and culminated in the final event on 9 February.

The roundtable comprised of three sessions, the first discussing investors protections as contractualised in the draft instrument on IICs against the backdrop of the ADB Investment Agreement Toolkit, the second comparing the draft instrument sections on sustainability and the ADB Environmental and Social Framework, and the third examining the draft instrument main principles and model clauses in light of ADB IICs practice.

The event was co-organised by Dr Rocco Palma and Ms Myrte Thijssen on behalf of UNIDROIT, and by Ms Christina Pak, Office of the General Counsel, and Mr Rolando Avendano, Economic Research and Development Impact Department, on behalf of the ADB, under the auspices of ADB Vice-President Ms Roberta Casali and the ADB General Counsel Mr Thomas Clark.

Several members of the UNIDROIT-ICC Working Group on IICs and researchers of the Roma Tre-UNIDROIT Task Force participated remotely and exchanged views on the content of the draft instrument in view of its finalisation.
