On the initiative of Don Wallace Jr, Chairman of the International Law Institute, Washington D.C., and of Christopher R. Seppälä, Legal Advisor of the FIDIC Contracts Committee, with the support of Mark Ellis, Executive Director of the IBA and Peter Bartlett, now Vice-Chair of the IBA Legal Practice Division, and on the basis of a Memorandum of Understanding stipulated between the IBA and UNIDROIT, the International Bar Association set up a task force composed of 51 specialised practitioners, advocates, arbitrators, professors, former judges, corporate counsel and transactional lawyers from 28 countries coordinated by Willem Calkoen (NautaDutilh N.V.). The task force had the aim of collecting information and giving views on the practical application of the UPICC, thereby assisting UNIDROIT to further promote awareness on their use in international contracts and dispute resolution practice all over the world.
On 28 and 29 May 2018 a meeting took place between Mr Calkoen and some of the members of the IBA task force on the one side and the President, the Secretary-General, the Deputy Secretary-General of UNIDROIT and Professor Michael Joachim Bonell on the other, for a first exchange of views as to how IBA and UNIDROIT could best cooperate in this respect.
A first presentation of the work done by the IBA task force took place at UNIDROIT on 12 October 2018, in conjunction with the IBA Annual Conference held in Rome, which also featured a panel on the IBA project.
The finalised publication by IBA is now available on-line.
