MAC PROTOCOL TO THE CAPE TOWN CONVENTION – SIGNATURE BY THE EUROPEAN UNION

On 20th September 2022, the European Union, which is already a Party to the Cape Town Convention, the Aircraft Protocol and the Luxembourg Rail Protocol, became Signatory of the MAC Protocol, which was adopted in November 2019 at a diplomatic Conference held in Pretoria.

 

H.E. Hana Hubáčková, Ambassador of the Czech Republic to Italy, Presidency-in Office of the Council of the European Union, and H.E. Antonio Parenti, Head of the European Commission Representation in Italy, signed, on behalf of the European Union, the MAC Protocol at a ceremony held at Unidroit Headquarters in Rome. They were received by Professor Ignacio Tirado, Unidroit Secretary-General, Professor Anna Veneziano, Deputy Secretary-General, and Ms Marina Schneider, Principal Legal Officer and Treaty Depositary.

H.E. Ambassador Hubáčková, upon signing the Protocol, stated that “Years of work on the MAC Protocol bring us closer to a more interconnected and prosperous world”. H.E. Antonio Parenti emphasised that “the signature by the EU of the MAC Protocol today is an important signal of political commitment to proceed in due time with the ratification. Member States are now allowed to sign themselves the Protocol”.

Secretary-General Ignacio Tirado, upon signature of the certificate acknowledging the signature of the European Union, underlined “that the MAC Protocol has the potential to be a game-changer for economic growth around the world”. There is indeed strong evidence that access to finance is conducive to economic growth. The MAC Protocol, if implemented effectively, should result in a legal system that protects creditors more effectively, thereby significantly reducing the cost of credit and improving its availability.
