From 14 to 19 November 2024, UNIDROIT Legal Officer Ms Philine Wehling taught the module on “International Harmonisation of Private Law” of the LL.M. in International Economic Law at the European School of Law (ESL), Toulouse Capitole University.
Over five sessions, the module firstly provided an introduction to the purposes, history, challenges and means of international harmonisation in the field of private law in general as well as key actors at global level, and subsequently focused on a selection of uniform law instruments and ongoing projects aimed at international harmonisation. In particular, session two addressed the UNIDROIT Principles of International Commercial Contracts (UPICC), discussing their preparatory history and content as well as the ways in which the Principles have been contributing to the harmonisation of international commercial contracts, dispute settlements, national legal reforms, and legal education over the past three decades. Session three provided comparative review of the various uses of the UPICC across geopolitical regions, as well as an analysis of the prerequisites of their application by national courts and arbitral institutions, and was complemented by a discussion of case studies from practice. The fourth session addressed other selected UNIDROIT instruments in the fields of secured transactions law, agricultural law, and private law and technology, examining how they have been fostering international harmonisation in their particular areas of scope. Finally, the last session of the module was dedicated to ongoing projects on UNIDROIT’s 2023-2025 Work Programme, focusing on those that aim to provide harmonised implementation of sustainability standards through private law instruments.
