UNIDROIT PARTICIPATES IN THE FIPROD – FOURTH EDITION

On 22 May 2026, Senior Legal Officer Ms Myrte Thijssen represented UNIDROIT at the fourth International Forum of Legal and Accounting Professionals (FIPROD), held in Lomé (Togo) from 20 to 23 May 2026 with the theme “Business Contractual Techniques in Africa: Mining, Energy, Gas, Infrastructure, Banking, Insurance, Transport, Information Technology & AI”.

During a Roundtable entitled “Contribution of National and International Institutions to the Sovereign Structuring of Contractual Practices in Africa,” Ms Thijssen delivered an online presentation on “Optimising Contractual Practices in Africa: The Contribution of UNIDROIT Models in a Trans-Systemic Legal Environment.” Her presentation highlighted how UNIDROIT instruments have contributed, and can continue to contribute, to improving commercial contractual practices in Africa. Structured around three parts, the presentation covered the UNIDROIT Principles of International Commercial Contracts (UPICC), the future UNIDROIT-ICC Principles and Model Clauses on International Investment Contracts, and two central themes addressed in this future instrument: stabilisation and sustainability.

In conclusion, Ms Thijssen emphasised that the future instrument aims to promote a balanced contractual framework for international investment projects. Drawing on the UPICC, it intends to offer guidance tailored to investment contracts, reconciling investor protection, sustainability, and regulatory flexibility through carefully designed contractual mechanisms. One of the key messages of the instrument is that robust investor protection and ambitious sustainability commitments are not mutually exclusive. On the contrary, these objectives can, and should, reinforce each other within a balanced contractual relationship.
