Cape Town Convention and Aircraft Protocol – Accession by the Republic of Iraq

On 26 January 2023, His Excellency, Mr Saywan Sabir Mustafa Barzani, Ambassador Extraordinary and Plenipotentiary of the Republic of Iraq in Italy, and Mr Zaid Tarik Mohammed Al-Ani, First Secretary of the Embassy of the Republic of Iraq in Italy, visited UNIDROIT to deposit Iraq’s instrument of accession to the Convention on International Interests in Mobile Equipment and to the Protocol to the Convention on International Interests in Mobile Equipment on Matters specific to Aircraft Equipment. H.E. Mr Barzani and Mr Al-Ani were welcomed by Professor Ignacio Tirado, Secretary-General, Professor Anna Veneziano, Deputy Secretary-General, and Ms Marina Schneider, Principal Legal Officer and Treaty Depositary.

Iraq made declarations under Articles 39(1)(a) and 54(2) of the Convention, and under Article XXX(1) and (2) the Aircraft Protocol. The Convention and the Aircraft Protocol will enter into force for Iraq on 1 May 2023. On this occasion, His Excellency, Mr Barzani made the following statement: “We are delighted to have visited UNIDROIT today to deposit Iraq’s approval of the Cape Town Convention and its Aircraft Protocol. We thank the Secretary General and his highly professional team for the warm welcome and the fruitful discussions we had. IRAQ also hopes to strengthen the cooperation with UNIDROIT in the next future, especially after the return of security and stability in Iraq.” Professor Tirado welcomed the Republic of Iraq as the 82nd State to accede to the Aircraft Protocol, contributing further to its unstoppable path as a truly global legal instrument. The Secretary General stressed the enormous potential that the other Protocols of the Cape Town Convention as well as other UNIDROIT instruments may have to decisively underpin Iraq’s economic recovery by strengthening its legal environment and allowing the country an enhanced and less costly access to credit.
