UNIDROIT Celebrates Berlin Declaration presented at IACL Conference

On 30 September, a special session took place within the IACL Conference dedicated to the UNIDROIT Principles on International Commercial Contracts. The Berlin Declaration on the UNIDROIT Principles of International Commercial Contracts, joining a broad international initiative to promote a neutral and practical framework for cross-border contracting and dispute resolution was issued at the World Congress of the International Academy of Comparative Law in Berlin. It was featured in a Report entitled “From Soft Law Formulation to Implementation as Hard Law: The Case of the UNIDROIT Principles of International Commercial Contracts”,  within the track “Legal Counselling as Transnational Rule Setting”. It is endorsed by 369 authors and co-authors from 103 jurisdictions, together with professional, academic, arbitration and business organisations worldwide.

The declaration was supported by 414 signatories: 27 organisations, including the UIA, AIJA, ICC Germany, the CISG Advisory Council, the IBA International Commerce and Distribution Committee, INCAM and the Ukrainian Bar Association, and leading figures in international private law, for a total of 374 co-authors from 104 jurisdictions across common law, civil law and mixed legal systems.

Based on resolutions passed in 2020 by the International Association of Lawyers – Union Internationale des Avocats (UIA) and in 2025 by the International Association of Young Lawyers – Association Internationale des Jeunes Avocats – (“AIJA”), the signatories of this Berlin Declaration aim to overcome the divide between different national legal systems, especially between parties from common and civil law countries with regard to international contracts, and to thereby facilitate international trade and, in particular, cross-border commercial contracts and international dispute resolution, by using the universal and neutral UNIDROIT Principles of International Commercial Contracts.
