UNIDROIT-ICC Project on International Investment Contracts featured at Paris Arbitration Week

On 26 March 2026, the joint project of UNIDROIT and the ICC Institute of World Business Law (ICC) on International Investment Contracts was presented during a dedicated workshop held as part of Paris Arbitration Week.

Hosted at the ICC Headquarters in Paris, the workshop brought together leading practitioners, academics, and arbitrators to discuss the ongoing development of the UNIDROIT-ICC Principles and Model Clauses on International Investment Contracts (IICs).

The workshop opened with introductory remarks by Eduardo Silva Romero, Chair of the ICC Institute Council and Co-Chair of the Working Group on IICs, who outlined the principal themes addressed in the draft instrument. Claudia Salomon, President of the ICC International Court of Arbitration, followed with reflections on the growing relevance of contract-based investment arbitration in the current dispute resolution landscape.

Maria Chiara Malaguti, UNIDROIT President Emerita and Co-Chair of the Working Group on IICs, provided insights into the origins of the project and its methodology, emphasising the collaborative approach that brings together individual experts, observer institutions, and a Consultative Committee composed of State-appointed specialists.

Further perspectives were offered by Giuditta Cordero-Moss, Professor at the University of Oslo and member of the Working Group, who elaborated on the commercial aspects addressed in the draft instrument and its relationship with the UNIDROIT Principles of International Commercial Contracts. Myrte Thijssen, Senior Legal Officer at UNIDROIT, addressed issues of stability and sustainability, explaining that the draft instrument seeks to demonstrate how effective investor protection and meaningful sustainability commitments can be pursued together in a balanced way.

Finally, Juan Pablo Argentato, Managing Counsel at the ICC International Court of Arbitration, discussed the draft instrument’s approach to choice of law and dispute settlement, highlighting the importance of amicable and alternative dispute resolution mechanisms, as well as means of reducing the risk of parallel proceedings.

The presentations were followed by a lively Q&A session, which demonstrated participants’ strong engagement with the topics discussed and underscored the need for practical guidance for the negotiation and implementation of modern, balanced international investment contracts.
