UNIDROIT participates in Bank of Italy conference marking 10 years of the Single Resolution Mechanism

On 12 December 2025, the Bank of Italy organised the conference “The Single Resolution Mechanism, ten years since” in Rome, as part of the celebrations marking the tenth anniversary of the Single Resolution Mechanism (SRM). The event opened with welcome remarks by Fabio Panetta, Governor of the Bank of Italy, and featured a keynote address by Dominique Laboureix, Chair of the Single Resolution Board.

UNIDROIT contributed to Session III, “Emerging challenges and possible way forward”, through an intervention by Senior Legal Officer Myrte Thijssen, who presented key insights from the UNIDROIT Legislative Guide on Bank Liquidation for the effective management of non-systemic bank failures. She emphasised the importance of the timely opening of bank liquidation proceedings to protect depositors and preserve value, and the effectiveness of a sale as a going concern tool in liquidation, combined with an appropriate creditor hierarchy and support from the deposit insurance system. Ms Thijssen also outlined the advantages of an administrative bank liquidation regime over a predominantly court-based insolvency process.

With specific reference to the European Union, she noted that the Legislative Guide could serve as a valuable tool to strengthen and promote convergence among Member States’ national bank insolvency frameworks, which is especially pertinent in light of the ongoing review of the EU crisis management and deposit insurance framework (CMDI review).

The session was moderated by Francesco Mauro (European Banking Authority). Other speakers included Ugo Bassi (European Commission), Christos Hadjiemmanuil (Bank of Greece), and Jaakko Weuro (Finnish Financial Stability Authority).
