FSI-UNIDROIT Policy Implementation Meeting on Bank Liquidation held in Basel

On 9 July 2025, UNIDROIT and the Financial Stability Institute (FSI) of the Bank for International Settlements (BIS) jointly organised a policy meeting on bank liquidation. Hosted at the BIS headquarters in Basel, the event focused on the recently adopted UNIDROIT Legislative Guide on Bank Liquidation.

The meeting brought together more than 200 experts, including representatives from public authorities responsible for bank failure management, academics, and insolvency practitioners. Participants discussed how the guidance provided in the Legislative Guide could be applied in practice across various legal systems and institutional arrangements.

The event opened with welcome addresses by Mr Fernando Restoy (Chair of the FSI) and Professor Ignacio Tirado (Secretary-General of UNIDROIT), followed by sessions on four key topics:

  1. Preparation for bank liquidation.
  2. Execution of principal liquidation strategies, namely transfers of assets and liabilities as a going concern and piecemeal liquidation.
  3. Funding mechanisms to support liquidation strategies, with a focus on the role of deposit insurance funds.
  4. Group and cross-border aspects of bank liquidation.

Each session began with introductory remarks by subject-matter experts to frame the discussion, followed by open round-table exchanges where participants shared experiences and perspectives.

The meeting was preceded by a dinner for in-person participants, during which Ms Elsie Addo Awadzi (former Deputy Governor of the Bank of Ghana) delivered a keynote speech highlighting the importance of appropriate tools to optimise outcomes in bank liquidation.

The UNIDROIT Legislative Guide is aimed at helping legislators and policymakers to design effective bank liquidation frameworks. It offers guidance on how frameworks can allow the failure of non-systemic banks to be managed in a way that recognises the special nature of their activities and liabilities and the public policy considerations that may arise in connection with the failure of any bank.
