SUBSEQUENT DECLARATIONS

LODGED BY THE DEMOCRATIC REPUBLIC OF THE CONGO UNDER THE AIRCRAFT PROTOCOL

 

[These declarations were notified on 28 April 2025 to UNIDROIT by the Government of the Democratic Republic of the Congo, as subsequent declarations pursuant to Article XXXIII(1) of the Aircraft Protocol, and in accordance with Article XXXIII(2) of the Aircraft Protocol, these subsequent declarations will take effect on 1 November 2025.]

 

Article XXX(1)

The Democratic Republic of the Congo declares, in accordance with Article XXX of the Protocol, that it will apply Article VIII of the Protocol.

The Democratic Republic of the Congo declares, in accordance with Article XXX of the Protocol, that it will apply Article XII of the Protocol.

The Democratic Republic of the Congo declares, in accordance with Article XXX of the Protocol, that it will apply Article XIII of the Protocol.

 

Article XXX(2)

The Democratic Republic of the Congo declares, in accordance with Article XXX(2), that it will apply Article X of the Protocol, and for purposes thereof, ‘speedy’ shall mean the number working days (i) for the remedies specified in Articles 13(1)(a), (b), and (c) of the Convention, equal to not more than 10 calendar days, and (ii) for the remedies specified in Articles 13(1)(d) and (e) of the Convention, equal to not more than 30 calendar days.

 

Article XXX(3)

The Democratic Republic of the Congo declares, in accordance with Article XXX of the Protocol, that it will apply Article XI, Alternative A of the Protocol in its entirety to all types of insolvency proceedings and all insolvency-related events and that the waiting period of the purposes of Article XI(3), Alternative A shall be 30 calendar days.
