UNIDROIT Delivers Guest Lecture on Bank Liquidation at Makerere University

On 11 September 2025, Senior Legal Officer Myrte Thijssen delivered a virtual guest lecture to law students at Makerere University (Uganda), as part of the university’s Law of Banking course. The session focused on the recently adopted UNIDROIT Legislative Guide on Bank Liquidation.
Ms Thijssen first explained the mandate and working methods of UNIDROIT, providing the students with the context for the development of the Guide. The session then explored why tailored liquidation regimes are needed for banks, with an engaging discussion on how banks differ from other companies. Ms Thijssen outlined the primary objectives of bank liquidation and discussed the strengths and potential limitations of different institutional frameworks, including administrative-led models and those primarily overseen by courts. The lecture also addressed the importance of effective liquidation tools, including the ability to transfer selected assets and liabilities to another bank, and emphasised the need for mechanisms that enable timely and coordinated action among relevant stakeholders to ensure orderly and efficient liquidation processes.
