UNIDROIT Holds the Centenary Contract Law Workstream’s Committee Workshop

On 29 June 2026, UNIDROIT held the Workshop of the Contract Law Workstream’s Committee at its Headquarters in Rome, organised within the framework of the International Programme for Law and Development (IPLD) Africa Plus. As part of the UNIDROIT Centenary Celebration, the Workshop brought together members of the Contract Law Workstream Committee and invited experts from academia and legal practice, together with the lawyers from across Africa participating in the IPLD Africa Plus Programme.

The Contract Law Workstream is the first of the Centenary Workstreams set up by UNIDROIT to organise a Workshop, providing an opportunity to present the draft White Paper prepared by the Committee to a broader audience of experts and stakeholders and to gather comments and recommendations that may inform its further development.

The Workshop was opened by Professor Arthur Hartkamp, Chair of the Contract Law Workstream, who introduced the draft White Paper, reflecting on the evolution of UNIDROIT’s work in contract law and the principal themes identified by the Workstream for future development.

The Workshop was organised around three thematic panels.

The first panel, chaired by Professor Anna Veneziano, featured presentations by Professors Giuditta Cordero-Moss, Neil Cohen, Yeşim Atamer, and Andrés Jana. Discussions explored the contribution of UNIDROIT’s soft law instruments to the harmonisation and modernisation of contract law, including the implementation and further development of the UNIDROIT Principles of International Commercial Contracts (UPICC), the principle of good faith and fair dealing, network contracts, and the relationship between contract law soft law instruments and international arbitration.

The second panel, chaired by Ms Myrte Thijssen, featured presentations by Professors María Pilar Perales Viscasillas, Hiroo Sono, Lauro Gama, and Yeşim Atamer. Discussions examined the relationship between general contract law and specialised contract law instruments, with particular attention to reinsurance contracts, distribution and franchise contracts, international investment contracts, and construction contracts.

The third panel, chaired by Dr Philine Wehling, featured presentations by Professor Christian Twigg-Flesner, who joined the Workshop online and Professors Yeşim Atamer, Hiroo Sono, and María Pilar Perales Viscasillas. Discussions explored the impact of new technologies, due diligence and sustainability, and other emerging developments affecting international contract law.

Following each panel, participants attending both in person and online engaged in lively discussions, drawing on perspectives from academia, legal practice, and with perspectives from different jurisdictions. The valuable questions, comments, and recommendations will be considered in the development of the White Paper.

As the first Workshop organised by a UNIDROIT Centenary Workstream, the event marked an important milestone in the Institute’s broader reflection on a century of work in the harmonisation of private law.
