DECLARATIONS LODGED BY THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND UNDER THE AIRCRAFT PROTOCOL AT THE TIME OF THE DEPOSIT OF ITS INSTRUMENT OF RATIFICATION

LODGED BY THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND
UNDER THE AIRCRAFT PROTOCOL
at the time of the deposit of its instrument of ratification
AND SUBSEQUENT DECLARATIONS

 

Pursuant to Article XXIX of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that the United Kingdom’s Ratification of the Protocol shall be extended to the territories of the Island of Guernsey, the Cayman Islands and Gibraltar for whose international relations the United Kingdom is responsible.

Pursuant to Article XXIX of the Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment (“the Protocol”), the Government of the United Kingdom of Great Britain and Northern Ireland declares that the ratification of the Protocol of the United Kingdom of Great Britain and Northern Ireland shall be extended to the territory of Bermuda for whose international relations the United Kingdom is responsible. *

Pursuant to Article XXIX of the Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment (“the Protocol”), the Government of the United Kingdom of Great Britain and Northern Ireland declares that the ratification of the Protocol of the United Kingdom of Great Britain and Northern Ireland shall be extended to the territory of the Isle of Man for whose international relations the United Kingdom is responsible. *

Pursuant to Article XXX(1) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Articles VIII and XII of the Protocol shall apply to the territories of the Cayman Islands and the Island of Guernsey.

Pursuant to Article XXX(1) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that it will apply Article XIII of the Protocol to the United Kingdom of Great Britain and Northern Ireland and the territories of the Cayman Islands and the Island of Guernsey.

Pursuant to Articles XXX(4) and XXX(1) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Articles VIII, XII and XIII of the Protocol shall apply to Bermuda. **

Pursuant to Articles XXX(4) and XXX(1) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Articles VIII, XII and XIII of the Protocol shall apply to the Isle of Man. **

Pursuant to Article XXX(2) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Article X of the Protocol shall apply to the Cayman Islands, and that the time period referred to in Article X(2) of the Protocol shall be 10 working days.

Pursuant to Article XXX(2) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Article X of the Protocol shall apply to the Island of Guernsey, and that the time period referred to in Article X(2) of the Protocol shall be 10 working days for the purposes of Article 13(1)(a) to (c) of the Convention and 30 working days for the purposes of Article 13(1)(d) and (e) of the Convention.

Pursuant to Article XXX(2) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Bermuda shall apply Article X of the Protocol in its entirety and that the number of days to be used for the purposes of the time-limit laid down in Article X(2) of the Protocol shall be 10 calendar days in Bermuda from the date the application for relief is filed. ***

Pursuant to Article XXX(2) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that paragraphs (3), (4) and (5) of Article X of the Protocol shall apply to the Isle of Man. ***

Pursuant to Article XXX(3) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Alternative A under Article XI of the Protocol shall apply to the Cayman Islands and the Island of Guernsey with a waiting period of 60 days.

Pursuant to Article XXX(3) of the Protocol, the Government of the United Kingdom of Great Britain and Northern Ireland declares that Bermuda shall apply Article XI, Alternative A of the Protocol in its entirety to all types of all insolvency proceedings ant that the waiting period for the purposes of Article XI(3) of that Alternative shall be sixty (60) calendar days. ****

INFORMATION

LODGED (at the time of ratification) BY THE UNITED KINGDOM UNDER THE AIRCRAFT PROTOCOL RELATING TO ARTICLE XI

 

The declarations made by the European Union under the Aircraft Protocol, together with the regulations referred to in those declarations, affect the capacity of EU Member States to make declarations under Articles XXX(2) and Article XXX(3) of the Aircraft Protocol, concerning Articles X and XI of the said Protocol. European Member States, however, may amend their national law so as to result in the same substantive outcomes as if a declaration had been made under Article XXX(2) or Article XXX(3).

Such information as provided by Contracting States to the Depositary is also indicated herein. However, the Depositary wishes to clarify that it has not independently confirmed its accuracy and is merely sharing the information as received from Contracting States.
