DECLARATIONS

LODGED BY THE REPUBLIC OF LITHUANIA UNDER THE CAPE TOWN CONVENTION AT THE TIME OF THE DEPOSIT OF ITS INSTRUMENT OF ACCESSION

 

[The declarations under Articles 39(1)(a)-(b), 40, and 54(2), deposited on 29 August 2025, will enter into force on 1 December 2025]

 

Declaration pursuant to Article 39(1)(a)

All non-consensual rights or interests which, under the law of the Republic of Lithuania, have and will continue to have priority over an interest equivalent to that of the holder of a registered international interest in the object, shall have priority over the registered international interest, whether or not insolvency proceedings are instituted and irrespective of whether such international interest was registered before the date on which the Republic of Lithuania ratifies the Protocol.

 

Declaration pursuant to Article 39(1)(b)

Nothing in the Convention shall affect the right of the Republic of Lithuania or any of its entities, any intergovernmental organization, or other private provider of public services to arrest or detain an object under the laws of the Republic of Lithuania for the payment of amounts owed to such entity, organization, or provider directly related to those services, with respect to that or another object.

 

Declaration pursuant to Article 40

A non-consensual right or interest arising under the law of the Republic of Lithuania, on the basis of which an object is arrested or detained, may be registered under the Convention as if it were an international interest and shall be regulated accordingly.

 

Declaration pursuant to Article 54(2)

Remedies available to the creditor under the provisions of the Convention, in respect of which it is not stated that application to the court is required, maybe exercised without leave of the court.
