ATELIER SUR LA LUTTE CONTRE LE TRAFIC ILLICITE DE BIENS CULTURELS

Les 17 et 20 décembre 2017, Mme Marina Schneider, juriste principale d’UNIDROIT, a participé activement à l’atelier intitulé «Lutte contre le trafic illicite de biens culturels» organisé conjointement par l’UNESCO et les Carabiniers italiens à Amman, en Jordanie.

À cette occasion, Mme Schneider a discuté de la procédure d’adhésion à la Convention d’UNIDROIT de 1995 sur les biens culturels volés ou illicitement exportés et des principales préoccupations des États arabes concernant l’adhésion.

 

 

 

 

CONFERENCE TO ASSESS THE IMPLEMENTATION OF UNSC RESOLUTION 2911/2015 FOR THE PROTECTION OF CULTURAL HERITAGE IN THE MIDDLE EAST (BEIRUT, 14-15 DECEMBER 2016)

 

Beyrouth, Liban: les 14 et 15 décembre 2016, Mme Marina Schneider, Juriste principale d’UNIDROIT, a participé à la Conférence organisée par INTERPOL  pour évaluer la mise en œuvre de la Résolution 2199 du Conseil de Sécurité des Nations Unies pour la protection du patrimoine culturel au Moyen-Orient à laquelle ont participé des délégations d’Iraq et de Syrie. Cette dernière a été menée par M. Maamoun Abdelkarim, Directeur General de la Direction Générale des Antiquités et des Musées (DGAM).

 

La Conférence a fait le point sur la lutte contre le trafic illicite de biens culturels en Iraq et en Syrie. Les experts ont insisté sur l’importance pour les Etats d’avoir des unités de police spécialisées, ainsi que des bases de données de biens volées qui soient connectées à la base d’INTERPOL. Les discussions ont également porté sur la nécessité de renforcer les législations nationales pour mieux mettre en œuvre les conventions internationales dans ce domaine, comme celles de l’UNESCO et d’UNIDROIT.

Mme Marina Schneider, juriste principale d’UNIDROIT, a participé à l’atelier de l’UNESCO sur la lutte contre le trafic illicite de biens culturels (Convention de 1970) pour l’Égypte et le Soudan, qui s’est tenu au Caire du 10 au 14 décembre 2017. Dans son allocution, Mme Schneider a examiné les avantages, pour la région arabe, de la ratification de la Convention d’UNIDROIT de 1995 sur les biens culturels volés ou illicitement exportés.

Nous reconnaissons tous que l’éducation est un outil clé pour la protection des biens culturels et la lutte contre le trafic illicite et l’UCAP est destiné à accroître la sensibilisation et la connaissance de la Convention d’UNIDROIT de 1995 sur les biens culturels volés ou illicitement exportés. Il vise à promouvoir et à mettre en relations les recherches pertinentes nationales et internationales réalisées par des entités et des universités organisant des cours dans le domaine du droit du patrimoine culturel, en particulier sur la Convention d’UNIDROIT de 1995. Il souhaite également promouvoir le développement de programmes ou de modules spécifiques.

GROUPE G7 ROME-LYON – REUNION SPECIALE D’EXPERTS

 

Le but de la réunion était de rassembler des experts de différents domaines afin de témoigner de leur expérience sur le sujet et d’imaginer des mesures à prendre pour lutter, à l’échelle mondiale, contre la destruction, le pillage et le commerce illicite des biens culturels.

RENFORCEMENT DES SYNERGIES POUR LA PROTECTION DU PATRIMOINE CULTUREL EN AFRIQUE DE L’EST ET DANS LES ETATS INSULAIRES VOISINS DE L’OCÉAN INDIEN

 

Le 20 juillet 2017 à Balaclava, République de Maurice, les Ministres de la Culture de Djibouti, d’Ethiopie, de Maurice, de Somalie et du Soudan du Sud ont publié une Déclaration conjointe sur le renforcement des synergies pour la protection du patrimoine culturel en Afrique de l’Est et dans les Etats insulaires voisins de l’océan Indien. La Déclaration repose sur 10 recommandations émanant d’une Conférence régionale et d’une Table ronde ministérielle sur la protection du patrimoine culturel, organisées par le Bureau Régional de l’UNESCO pour l’Afrique de l’Est du 18 au 19 juillet 2017.

Des experts d’UNIDROIT, du Comité international de la Croix-Rouge, d’INTERPOL, du Conseil international des musées, du Conseil International des Monuments et des Sites, du Fonds pour le Patrimoine Mondial Africain, duCentre for Heritage Development in Africa (CHDA) figuraient parmi les organisations partenaires de l’UNESCO participant à la Conférence et partageant leur expertise et leurs ressources.

UNIVERSITE D’ETE DE GENEVE

 

Le 14 juin 2017, Mme Marina Schneider, juriste principale d’UNIDROIT, a donné un cours aux étudiants de l’Université d’été de Genève (Geneva Summer School of International Cultural Heritage Law) sur les faiblesses de la Convention de l’UNESCO de 1970, la Convention d’UNIDROIT de 1995 et les Dispositions modèles UNESCO-UNIDROIT établissant la propriété de l’Etat sur les biens culturels non découverts.

4EME REUNION DES ETATS PARTIES A LA CONVENTION DE 1970 ET 5EME REUNION DU COMITE SUBSIDIAIRE

 

Du 15 au 19 mai 2017, Mme Marina Schneider, Juriste principale et Dépositaire des Traités d’UNIDROIT, a participé à la quatrième Réunion des Etats parties à la Convention de 1970 concernant les mesures à prendre pour interdire et empêcher l’importation, l’exportation et le transfert de propriété illicites des biens culturels et à la Cinquième Réunion du Comité Subsidiaire de la Réunion des Etats Parties à la Convention de 1970, tenues au Siège de l’UNESCO à Paris.

ATELIER DE L’UNESCO SUR L’ÉTHIQUE DES COLLECTIONS ET LA LUTTE CONTRE LE TRAFIC ILLICITE DES BIENS CULTURELS DANS LES PAYS DU CONSEIL DE COOPÉRATION DU GOLFE (GCC)

 

Mme Marina Schneider, Juriste principale et Dépositaire des Traités d’UNIDROIT, a pris part à un séminaire de trois jours consacré à l’éthique des collections et la lutte contre le trafic illicite des biens culturels dans le Conseil de Coopération du Golfe (GCC), organisé par l’UNESCO et l’Autorité du Tourisme et de la Culture des Emirats, à Abu Dhabi, du 2 au 4 avril 2017.

Le séminaire fait partie des initiatives de l’UNESCO pour le renforcement des capacités et s’inscrit comme le premier séminaire de son genre, dans la région, rassemblant des représentants d’autorités culturelles issus des pays du GCC, de musées publics et privés, collectionneurs et maisons d’enchères ainsi que des experts issus d’institutions telles que l’UNESCO, INTERPOL, WCO-OMD, ICOM, ONUDC.

LA PREMIERE REUNION DU G7 SUR LA CULTURE

 

Les 30 et 31 mars 2017, UNIDROIT a été invité à participer à la première réunion du G7 sur la culture dans l’histoire du G7, organisée par l’Italie à Florence.

La Réunion ministérielle à laquelle a assisté le Prof. Anna Veneziano, Secrétaire général adjoint d’UNIDROIT, a été précédée d’une réunion technique sur les défis et les opportunités du cadre juridique actuel, les meilleures stratégies et mesures préventives pour la sauvegarde des biens culturels contre le trafic illicite, et les améliorations en termes de sensibilisation et éducation à laquelle UNIDROIT a apporté sa contribution.

La Déclaration signée par les sept Ministres de la culture invite instamment les Etats à renforcer la sauvegarde et la préservation du patrimoine culturel, à identifier et à partager les meilleures pratiques appropriées pour lutter contre toutes les formes d’activités illégales dans ce domaine, ainsi qu’à ratifier les conventions pertinentes existantes contre le trafic illicite de biens culturels parmi lesquelles la Convention d’UNIDROIT de 1995 sur les biens culturels volés ou illicitement exportés.

LES COLLECTIONS PRIVÉES : APPROCHES HISTORIQUES ET JURIDIQUES

Le 16-17 mars 2017, UNIDROIT a accueilli une conférence de deux jours sur : « Les collections privées : Approches historiques et juridiques » en collaboration avec la Société Internationale pour la recherche sur le droit du patrimoine (ISCHAL), l’Institut des sciences sociales du politique (ISP), le cabinet BonelliErede, l’Institut – Droit Ethique – Patrimoine (IDEP), l’Institut d’études de droit public (IEDP), l’Università degli Studi di Milano et l’Université des Etudes de Genève.

FORUM D’INTERPOL: “UNITY FOR SECURITY”

 

Du 28 au 30 mars 2017, Mme Marina Schneider, Juriste principale et Dépositaire des Traités d’UNIDROIT, a participé au travail du Forum d’INTERPOL “Unity For Security”, tenu à Abu Dhabi et organisé en partenariat avec les Emirats Arabes Unis et la Fondation Interpol pour un monde plus sûr, sous le patronage de son Eminence le Sheik Sheikh Khalifa bin Zayed Al Nahyan, Président des Emirats Arabes Unis.

Le Forum rassemblait des Ministres dont les responsabilités comprennent la sécurité nationale, des hauts fonctionnaires de la police, des représentants du secteur privé, pour traiter ensemble des questions communes et identifier les responsabilités de chacun dans la mise en oeuvre de politiques générales pour lutter contre les menaces futures.

EVÉNEMENT SPÉCIAL: “PROMOUVOIR ET RENFORCER LE CADRE JURIDIQUE INTERNATIONAL POUR LA PROTECTION DU PATRIMOINE CULTUREL” – AU SIÈGE DE L’ORGANISATION DES NATIONS UNIES.

 

La manifestation intitulée “Promouvoir et renforcer le cadre juridique international pour la protection du patrimoine culturel” a eu lieu mardi 28 février 2017 au siège de l’Organisation des Nations Unies, co-organisée par les Missions Permanentes de Chypre et de l’Italie aux Nations Unies et par UNIDROIT.

Lors de l’événement, UNIDROIT et les Missions de Chypre et l’Italie aux Nations Unies ont annoncé l’établissement d’un Groupe de travail informel, ouvert à tous les Etats souhaitant y participer dans l’objectif de promouvoir une ratification plus large de la Convention d’UNIDROIT de 1995.

Le Groupe de travail sera coordonné par UNIDROIT, assisté par le Projet Académique de la Convention d’UNIDROIT de 1995 qui sera lancé dans un futur proche, et se réunira à New York sur une base annuelle en tant que plateforme d’échange de perspectives sur des sujets tels que l’état de ratification de la Convention d’UNIDROIT de 1995, la promotion d’activités de sensibilisation, d’informations et d’échange de bonnes pratiques, ainsi que la formation et l’éducation qui visent à assister en vue de l’adhésion, la ratification et la mise en oeuvre de la Convention d’UNIDROIT de 1995.

REUNION DU COMITE SUR LES INFRACTIONS VISANT LES BIENS CULTURELS

 

Du 20-24 février 2017, Le Conseil de l’Europe reçoit la quatrième et dernière Assemblée Plénière pour la rédaction de la nouvelle Convention sur les infractions pénales en vue de lutter contre le trafic illicite des biens culturels.

Mme Marina Schneider, Juriste principale d’UNIDROIT, a contribué au travail du Comité sur les Infractions visant les Biens Culturels.

4TH EU CULTNET MEETING

 

Les 8 et 9 février 2017, UNIDROIT a pris part à une conférence de deux jours intitulée: ” Autorités chargées de l’application de la loi et compétents dans le domaine des biens culturels ». La réunion avait pour objectif de faire aboutir les initiatives prises par le mandat EU CULTNET pour améliorer l’efficacité des mesures préventives dans la lutte contre les infractions relatives aux biens culturels à plusieurs niveaux, tel que défini dans le programme de travail établi pour l’année 2017 and dans le cadre de la résolution du Conseil doc. No.14232/12 du 04/10/2012.

 

Mme Marine Schneider, Juriste principale d’UNIDROIT, a également rencontré Dr. Owen Bonnici, Ministre de la Justice, Culture et Gouvernance locale, Dr. Peter Gretch, Procureur Général, Mme Catherine Tabone, Directeur-Culture et Mr Nathaniel Cutajar, Superintendance du patrimoine culturel.

TABLE RONDE SUR LA RECONSTRUCTION POST-CONFLIT DES VILLES HISTORIQUES (LENS, 20-21 JANVIER 2017)

En lien avec l’exposition « L’histoire commence en Mésopotamie » ouverte au public jusqu’au 23 janvier 2017, et en réponse aux événements actuels au Moyen-Orient, le Musée du Louvre-Lens et l’ICCROM, par le biais de son Centre régional de conservation ICCROM-ATHAR aux Emirats Arabes Unis, organisent une table ronde de deux jours consacrée à la reconstruction post-conflit des villes historiques.

Ces deux journées, qui se tiendront les vendredi 20 et samedi 21 janvier 2017 à Lens, ont pour ambition de rassembler des spécialistes internationaux afin d’échanger sur des cas concrets permettant ainsi de continuer les réflexions engagées lors de précédents colloques dédiés aux villes historique impactées par la guerre et le processus de reconstruction post-conflit.

La première journée s’organisera autour de quatre tables rondes : Réflexions sur la reconstruction post-conflit Mise en œuvre par les organisations internationales ; Etudes de cas régionaux (France, Pologne, Allemagne et Bosnie) ; Etudes de cas au Moyen-Orient (Beyrouth et Alep). Cette première journée se terminera par une restitution des travaux. Le deuxième jour sera, quant à lui, axé sur le rôle des agences de développement dans les processus de reconstruction.

COLLOQUE DU CONSEIL DE L’EUROPE SUR LA PROTECTION DU PATRIMOINE CULTUREL CONTRE LA DESTRUCTION ET LE TRAFIC (STRASBOURG, 13 JANVIER 2017)

 

Le 13 janvier, des représentants de haut niveau d’organisations internationales et de gouvernements nationaux, ainsi que des experts académiques se réuniront à Strasbourg pour un colloque visant à renforcer la coopération en matière de protection du patrimoine culturel contre la destruction délibérée et de prévention du trafic de biens culturels.

Organisée conjointement par la Présidence chypriote du Comité des Ministres du Conseil de l’Europe et par le Secrétaire Général de l’Organisation, M. Thorbjorn Jagland, cette manifestation s’intéressera tout particulièrement aux fouilles illicites et à la vente et à l’achat de biens culturels, des activités lucratives souvent liées au crime transnational organisé et au terrorisme.

Parmi les orateurs principaux, le ministre des Affaires étrangères de Chypre, M. Ioannis Kasoulides, la Directrice Générale de l’UNESCO, Mme Irina Bokova, et le Directeur Général de la Direction Générale des Antiquités et des Musées de Syrie, M. Mammoun Abdulkarim et Fatou Bensouda, Procureure Générale de la Cour Pénale Internationale. S’adresseront également à l’événement Hans-Holger Herrnfeld, Président du Comité sur les Infractions visant les Biens Culturels (PC-IBC), et Anna Veneziano, Secrétaire générale adjointe d’UNIDROIT.

Le Conseil de l’Europe prépare actuellement une nouvelle convention sur les infractions visant les biens culturels, qui deviendra le seul traité international consacré aux mesures et sanctions pénales contre les activités illicites dans le domaine du patrimoine culturel.

REUNION INTERNATIONALE DE COORDINATION SUR LE PATRIMOINE CULTUREL DANS LES ZONES LIBEREES D’IRAQ

 

Après que le bureau régional de l’UNESCO ait dirigé une mission d’évaluation rapide sur le site archéologique de Nimroud, le 14 décembre 2016, pour évaluer l’étendue des dommages résultant de destructions délibérées sur le site par le groupe extrémiste ISIS/Daesh au cours des 2 dernières, les actions de sauvegarde et de rétablissement à plus long terme du site seront présentées par l’UNESCO et discutées avec les principaux partenaires nationaux et internationaux, en ce compris UNIDROIT, lors d’une réunion internationale de coordination sur le patrimoine culturel dans les zones libérées d’Iraq, tenue au siège de l’UNESCO à Paris les 23-24 février 2017.

  • UNESCO Office in Venice – UNESCO Regional Bureau for Science and Culture in Europe (BRESCE) organised, in co-operation with the Ministry of Culture of the Former Yugoslav Republic of Macedonia, a regional workshop on the prevention of illicit traffic of cultural heritage and other illegal actions which was held in Ohrid in March 2006.  Programme.  Recommendations.
  • The Ministry of Culture of Albania together with the UNESCO Office in Venice – UNESCO Regional Bureau for Science and Culture in Europe (BRESCE) held an international meeting on the fight against illicit traffic in cultural objects in Tirana (Albania), June 2006.  Programme.
  • In the context of its programme relating to information on and promotion of existing international instruments, the International Trade Center UNCTAD/WTO (ITC) has organised a workshop in Vietnam (Hanoi), at which Prof. Kessedjan (Paris) presented the 1995 Unidroit Convention.
  • Prof. Philippe Kahn (France) has made a presentation of the integration of the 1995 UNIDROIT Convention in French law at a seminar organised by the CNRS on the protection of archives in Paris on 15 June 2006.
  • The Mexican Ministry of Foreign Affairs and the Mexican Center of Uniform Law organised, under the auspices of UNIDROIT, an international seminar on the legal protection of cultural objects (Mexico City, September 2006).
  • European Center for Peace and Development (ECPD), together with the Republic Institute for the Protection of Cultural, Historical and Natural Heritage of Srpska, held an international seminar in Banja Luka (Bosnia-Herzegovina), October 2006.
  • The Convention has also been discussed at a workshop on harmonisation of business law organised in Tshwane (South Africa) by the African Union.

  • 13thsession of the UNESCO Intergovernmental Committee for Promoting the Return of Cultural Property to its Countries of Origin or its Restitution in Case of Illicit Appropriation was held in Paris in February 2005.
  • The Italian Association of Historic Houses organised in Rome, on 15 April 2005, a conference at which the Secretariat of Unidroit was invited to explain the benefits private owners would get from the Convention in case their cultural objects were stolen or illegally exported.
  • International Colloquium on the legal protection of cultural objects organised in May 2005 by the Law Faculty of the University of Annaba (Algeria) – the Convention was extensively presented to representatives of the Maghreb countries, Iraq and Syria.
  • 6thInternational Symposium on the Theft of and Illicit Traffic in Works of Art, Cultural Property and Antiques organised by ICPO-INTERPOL in Lyon, June 2005; more than 40 countries and ten international organisations were represented at the Symposium.
  • The Spanish Guardia Civil and the TAIEX (Directorate General Enlargement of the European Commission) co-organised an International Seminar on Illegal Trafficking of Cultural Goods in Madrid from 29th November to 1st December 2005, for new Member States, Candidate Countries and Western Balkan countries in particular.

  • The French Observatoire des mouvements internationaux d’oeuvres d’art has invited a member of the Secretariat to attend two meetings, one of which totally devoted to the 1995 Convention (Paris, 24 March and 26 May 2004). It has been an opportunity to meet persons from all professional categories of the art world in France to make the Convention better known.
  • The Ministry of Culture, following the accession of the Republic of Azerbaijan to the Convention in 2003, organised a Conference totally devoted to the 1995 Convention to explain to the professionals how to better apply the Convention (Baku, June 2004).
  • In the context of the Dutch presidency of the European Union, the Dutch Ministry of Culture organised a Conference entitled “Fighting Illicit Traffic in Cultural Goods within the European Union” which emphasised in particular the implementation of the European texts in this field, as well as the two relevant international conventions, the 1995 Unidroit Convention being one (Rotterdam, November 2004)
